Please read these Terms and Conditions carefully before placing an order. By placing an order with us, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our services.
1. About Us
Fabyoula ("we", "us", "our") is a business registered in England and Wales. We operate the website at fabyoula.com. You can contact us at hello@fabyoula.com.
2. Definitions
- • "Customer", "you", "your" means the person placing an order through our website.
- • "Book" means a personalised children's book created to your specific requirements.
- • "Digital Book" means a PDF or digital file version of the Book delivered electronically.
- • "Physical Book" means a printed, physical copy of the Book delivered by post or courier.
- • "Photo" means any photograph or image you upload to our website for use in creating AI-generated illustrations.
- • "AI Illustrations" means the artwork generated using artificial intelligence tools based on your uploaded Photo and instructions.
- • "Personalisation Details" means the names, ages, descriptions, preferences, and other details you provide to customise your Book.
3. Our Services
We create bespoke, personalised children's books using the Personalisation Details and Photos you provide. Each Book is uniquely created for you and is not a stock product. Once your order is accepted and production begins, the Book is created exclusively for you.
Because every Book is a bespoke item made to your specific personal specifications, it is not possible for us to resell, reuse, or repurpose your Book for any other customer.
4. Placing an Order
4.1 How to Order
To place an order, you must: (a) complete the order form on our website; (b) provide all required Personalisation Details accurately; (c) upload any required Photos; and (d) pay the full purchase price at checkout.
4.2 Order Acceptance
Your order constitutes an offer to us to purchase a Book. We will confirm receipt of your order by email, but this does not constitute acceptance. A binding contract between us is formed only when we send you a separate order confirmation email stating that we have accepted your order.
We reserve the right to refuse or cancel an order at any time before acceptance, including if: we are unable to process the uploaded Photo for technical or quality reasons; the Personalisation Details provided are incomplete, unclear, or contain inappropriate content; or payment is not successfully processed.
4.3 Accuracy of Information
You are responsible for ensuring that all Personalisation Details and Photos you provide are accurate, complete, and of sufficient quality. We cannot be held responsible for errors in the finished Book that result from inaccurate or unclear information you have provided. Where errors are your responsibility, any reprinting or changes will be chargeable.
5. Pricing and Payment
All prices are displayed on our website and are inclusive of VAT where applicable. Prices are in pounds sterling (GBP). We reserve the right to change prices at any time, but changes will not affect orders already accepted.
Payment is taken in full at the time of ordering. We accept the payment methods listed on our website. Your payment details are processed securely by our third-party payment provider (Stripe) and are not stored by us.
6. Production and Delivery
6.1 Production Times
Estimated production times are displayed on our website at the time of ordering. These are estimates only and not guaranteed delivery dates. Production begins only after your order has been accepted and all required information and Photos have been received and approved.
6.2 Digital Books
Digital Books will be delivered to the email address you provide within the estimated timeframe. You are responsible for ensuring you provide a correct and accessible email address. We are not responsible for delivery failures caused by full inboxes, spam filters, or incorrect email addresses.
6.3 Physical Books
Physical Books will be dispatched to the delivery address you provide. Delivery times are estimates and may vary. Risk in the Physical Book passes to you upon delivery. We recommend you check your order upon receipt and notify us of any damage within 48 hours.
6.4 Delays
We will not be liable for delays caused by circumstances outside our reasonable control, including postal strikes, extreme weather, or supplier issues. We will notify you of any significant delay.
7. Bespoke Nature of Orders — Right to Cancel
Important Notice
Because each Book is made to your personal specifications, your order is for a bespoke, personalised item. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the standard 14-day cooling-off right for distance contracts does NOT apply to goods that are clearly personalised or made to the consumer's specifications.
This means:
- • Once you have submitted your order and it has been accepted, you do not have an automatic right to cancel and receive a refund simply because you have changed your mind.
- • We strongly encourage you to review all Personalisation Details and Photos carefully before submitting your order.
- • If you contact us before production has commenced, we will consider cancellation requests at our discretion, but we are not obligated to accept them.
This does not affect your statutory rights in relation to faulty or misdescribed goods, as detailed in Section 8 below.
8. Faulty or Incorrect Books — Your Statutory Rights
Nothing in these Terms affects your rights under the Consumer Rights Act 2015. If your Book is:
- • Faulty, damaged, or defective (not caused by you or your inputs);
- • Not as described on our website; or
- • Materially different from the order confirmation we sent you,
you are entitled to a remedy. Please contact us at hello@fabyoula.com within 30 days of receiving your Book with a description of the issue and, where relevant, photographs of any physical defect.
Where a fault is confirmed to be ours, we will offer one of the following remedies at our discretion: (a) a replacement Book; (b) a partial or full refund; or (c) a reprint of the affected pages (Physical Books).
Please note: We cannot be responsible for errors in the Book that result from Personalisation Details or Photos you provided that were inaccurate, unclear, or of insufficient quality. Any error of this nature is not a fault on our part.
9. Intellectual Property
9.1 Your Content
You retain ownership of any Photos you upload. By uploading a Photo, you grant us a limited, non-exclusive licence to use it solely for the purpose of creating your Book. We will not use your Photo for any other purpose.
9.2 Our Content
The text, story, layout, design templates, and AI-generated illustrations created by us for your Book are owned by us or our licensors. Upon full payment, we grant you a personal, non-commercial licence to use your Book for private, household use only.
9.3 Restrictions
You may not reproduce, distribute, sell, publish, or commercially exploit the content of your Book without our prior written consent. The Book is created for your personal use only.
9.4 AI-Generated Illustrations
Illustrations in your Book are created using AI generation tools. While we make every effort to ensure uniqueness, we cannot guarantee that AI-generated elements will be entirely unique compared to other outputs from the same tools. The illustrations are generated specifically for your Book and will not be reused or resold by us.
10. Acceptable Use
When providing Personalisation Details and uploading Photos, you agree not to submit content that:
- • Is unlawful, offensive, threatening, defamatory, obscene, or discriminatory;
- • Infringes the intellectual property rights of any third party;
- • Contains images of persons who have not consented to their use, or where you do not have the right to submit the image;
- • Is harmful to children or depicts any child in an inappropriate manner;
- • Depicts or promotes illegal activity.
We reserve the right to refuse to process any order where submitted content breaches these conditions.
11. Limitation of Liability
To the extent permitted by law:
- • We are not liable for any indirect, consequential, or special losses arising from your use of our services.
- • Our total liability to you in connection with any order shall not exceed the price paid by you for that order.
- • We do not exclude or limit liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. As a consumer, you retain the benefit of any mandatory consumer protections in your country of residence.
13. Changes to These Terms
We may update these Terms from time to time. The version in force at the time of your order is the version that applies to your purchase. We will post updates on our website.
